A 28-year-old Juneau man indicted for selling OxyContin while out on bail on a separate drug charge pleaded guilty Tuesday to two felony counts.
Dillinger Graham pleaded guilty in Superior Court to a felony drug charge for selling methamphetamine in July and to a felony drug charge for attempting to buy OxyContin in March. Sentencing has been scheduled for Jan. 13.
Graham was arrested March 19 in an undercover drug sting at the Travelodge Hotel in the Mendenhall Valley where he was alleged to be the financier of the buy. Prosecutors alleged that Loretta McCutcheon arranged a drug deal with an undercover informant to purchase 400 80-milligram OxyContin pills for $21,000, but scaled back her purchase to a "10-pack" for $1,000, according to court documents. She pleaded guilty to one felony count in April.
McCutcheon was arrested in the hotel and police located Graham in a vehicle outside. Police searched Graham and discovered a white pill, a portion of an OxyContin pill, and two pouches with plastic bags of methamphetamine.
After being read his Miranda rights, Graham told an investigator, "I was going to trade my meth for a few OxyContin. The meth is mine. I bought it from a friend," according to court documents.
A judge later ruled that because Graham made the incriminating statements about the drugs found on him after an illegal search, those statements are "tainted by the illegality," and suppressed both the physical evidence and statements made during his arrest.
A grand jury handed down a five-count felony indictment late last month alleging Graham sold methamphetamine and OxyContin to a confidential informant on two occasions in July while out on bail for the original case.
Graham allegedly sold one gram of methamphetamine for $160 to a confidential informant in the parking lot of Grant's Plaza in Lemon Creek. The transaction was observed by the Juneau Police Department, according to court documents. The confidential informant told police Dillinger had "displayed several gram bags of methamphetamine and approximately 20 OxyContin pills for sale" and wanted the informant to purchase more than one gram, the documents said.
Three days later on July 23, Graham sold a gram of methamphetamine and one OxyContin pill at Dimond Park to the same informant while police made an audio recording of the transaction, according to court documents.
Graham pleaded guilty Tuesday to one count of misconduct involving a controlled substance in the fourth degree for selling methamphetamine. The charge carries a sentence of one to three years in prison.
Tuesday's plea agreement was not a sentencing bargain and the time to be served in prison is left to the discretion of the judge.
